Could Legal 'Loophole' Lead to Land Claims on Other Worlds?

Oh no, Im not at all disputing that if theres no clear assurance of title to resources gathered, then its a non-starter. What Im questioning is if the original economic opportunity beyond the Earth can be sale of property lots. Perhaps Simbergs proposal doesnt emphasize that aspect. (Ive read about it, but havent read it.) But a few years back there was a proposal to jump-start space settlement via land grants (and that was when I formed my opinion on this subject).
