You can try. Mount Everest is not a controlled environment;
unlike a launch vehicle.

If a sudden wind or lightning destroyed the vehicle; you'd
probably be able to claim "Act of God", but most deaths are
going to be caused by equipment failure, or I would very much
expect that atleast.

Most deaths on Everest are probably caused by weather, falls,
altitude sickness etc. Who you gonna sue? Meteorologists?
